The Civil Division of the Maricopa County Sheriff's Office is responsible as mandated by the Arizona Constitution, State Statutes and Court Decree in the service, processing, and execution of all Criminal/Civil Process of the Maricopa County Superior Court. Additionally, the Division is responsible for the collection of delinquent Tax Bills forwarded from the County Assessor's Office, the licensing of all Pawnshops within Maricopa County, the approval/disapproval of ATF applications for a weapons III firearm acquisition and the service of warrants generated by Sheriff's Office actions, including child custody and child support warrants.

The service of Maricopa County Justice Court processes are the responsibility of the Constable elected to the justice court precinct. The Sheriff's Office Civil Division does not routinely serve Justice Court processes.

Due to the nature of court proceedings and procedures, deputies will only serve processes Monday – Friday during hours that are authorized by statutes (excluding holidays).All processes will be served in accordance with Arizona Statutes and Arizona Rules of Civil Procedures unless otherwise directed in writing. Please allow 2-3 weeks for service.

As the Chief Law Enforcement Officer in Maricopa County, the Maricopa County Sheriff’s Office ATF Unit is responsible for accepting and processing Bureau of Alcohol, Tobacco and Firearms (BATF) Form 4; Tax Paid Transfer and Registration of a Firearm Weapon Class III and Form 1; Application to Make and Register a Firearm applications.

The Sheriff’s Office does not furnish any of the BATF forms. To obtain current forms from BATF, either contact them by telephone or visit their website and download any of the forms.

Please note that BATF will not accept the application if front and back are on separate sheets of paper.

The Sheriff’s Office ATF Unit does not perform quality control regarding any of the forms used by BATF. Any questions on how to complete the BATF forms or any other related questions must be directed to Bureau of Alcohol, Tobacco and Firearms directly. The Sheriff’s Office is not responsible for returned forms due to improper completion by the applicant.

The Civil Process Unit is responsible for serving all Superior Court civil processes including subpoenas, writs of execution, garnishment, restitution, replevins and attachment, orders of protection and injunctions against harassment, as well as various other in-state and out-of-state court documents. The Division levies on various forms of personal and real property, then disposing of the property through a Sheriff's auction. Please allow 2-3 weeks for service.

ATF Application

The Maricopa County Sheriff’s Office is mandated by law to issue and renew pawnbroker licenses within Maricopa County and verify compliance with statutory requirements in accordance with Arizona Revised Statute 44-1621 – 44-1632. This responsibility is fulfilled by the Sheriff’s Office Pawnshop Detail. In addition to the duties above, the Pawnshop Detail also coordinates license suspension hearings between pawnshops and law enforcement agencies.

The Pawnshop Detail receives pawn tickets from pawn shops located in the county area and conducts inspections to ensure compliance with Arizona Revised Statutes. Pawn shops located within a city’s boundary will submit tickets to their respective local police department.

Interested applicants may contact the Pawnshop Detail at telephone 602-876-1844 and request a packet be mailed to them. The packet outlines specific requirements relating to forms, fingerprint cards and fees. Please allow approximately 120 days processing time from the date we receive the application until the pawnbroker license is approved.

Additionally, if the pawnshop is located in an unincorporated area, please contact the County Planning and Zoning Department at telephone number 602-506-3301 for any requirements and/or restrictions. If the pawnshop is located within city’s boundary, please contact the city zoning department for any zoning restrictions and the local police department pawn detail regarding city licensing and ticket requirements.

Pawnbroker Licenses renew on January 1st each year. The Pawnshop Detail mail renewal forms out approximately 120 days prior to the renewal date. Please note that it is the pawnbroker license owner’s responsibility to ensure compliance with state statute and contact the Pawnshop Detail prior to the renewal date if no renewal forms have been received.

The Subpoena Unit processes and serves all Superior Court and out-of-county justice court criminal subpoenas. They indicate on the original subpoena the type of service made and attempt to locate subjects that have moved prior to subpoena issuance. These include criminal, mental health and juvenile subpoenas.

The Tax Unit collects delinquent personal property taxes issued by the Maricopa County Treasurer and conducts Sheriff's auctions on personal property seized to satisfy delinquent personal property tax bills. They identify and forward all bankruptcy claims involving delinquent personal property taxes to the County Attorney for bankruptcy discharge follow-up.
